OFCCP Updates Disability Self-ID Form

Since March of 2014, OFCCP has required federal contractors to use a specific Voluntary Self-Identification of Disability form when inviting applicants to identify their disability status at the pre and post-offer stage of the hiring process. The form is also used when your organization surveys its workforce. The mandatory form is authorized by the Office of Management and Budget (OMB). The 2014 version of the form expired on January 31, 2017. Last week, the federal Office of Management and Budget approved the form for another three years, which will expire on January 31, 2020. HR Specialties advises switching to the new form as quickly as possible, including updating the form within electronic applicant tracking systems. This is because OFCCP’s Disability regulations require employers to use the form with the valid OMB approval date. A PDF version of the new version attached. Changes in DOL and OFCCP

President-elect Donald Trump has chosen Andrew Puzder to be Secretary of Labor.  Puzder is chief executive of CKE Restaurants, the parent company of the Hardee’s and Carl’s Jr. fast food chains.  Pudzer has a law background and has vocally opposed raising the federal minimum wage as well as the Department of Labor’s (DOL’s) recent federal overtime rule. The appointment of a new Director of the OFCCP is still pending.  Patricia Shui, Director of the Agency during the Obama administration, left her position on November 6, 2016.  Deputy Director, Tom Dowd, is the acting Interim Director. Fair Pay & Workplaces Rule Update

On October 24, 2016, one day before the Fair Pay and Safe Workplaces Rule was to go into effect, a federal judge in Texas issued a preliminary injunction that places a nationwide hold on implementing the contracting portions of the “blacklisting” rule. The ruling was issued in a lawsuit filed by the Associated Builders and Contractors of Southeast Texas. The injunction does not apply to the paycheck transparency requirements, which will still become effective January 1, 2017 for covered federal contractors and subcontractors. The filing deadline for the EEO-1 and VETS-4212 reports are on September 30, 2016. “Who needs to file an EEO-1 report?” All companies that are subject to Title VII, and have 100 or more employees.  Also, companies that have fewer than 100 employees, but is owned by or corporately affiliated with another company, and the entire enterprise employs a total of 100 or more employees. Federal contractors subject to Executive Order 11246, with 50 or more employees and contracts or subcontracts amounting to $50,000 or more. Companies with fewer than 50 employees, but have a federal government contract or subcontract worth $50,000 or more do not have to file. “Who needs to file a VETS-4212 report?” All Federal contractors and subcontractors with a contract or subcontract in the amount of $150,000 or more. On July 14, 2016 the EEOC issued a revision to the proposed EEO-1 pay data collection report.  The revision addressed some of the employer concerns submitted to the agency after the release in February of this year.   The Proposed Rules lay out new pay reporting components for employers, requiring them to report the number of employees that fall into each of the “pay bands” within each EEO-1 category.  In addition to the counts, employers will also report the total number of hours worked by those employees.   The revised update of the Proposed Rules move the filing due date from September 30 to March 31st, allowing employers to use W-2 income data from the prior year.  Employers will count their employees from a pay period between October 1st and December 31st and use W-2 income and hours-worked data for these employees for the entire year, ending December 31st.   The first filing under the new requirements would be March 31st, 2018 using pay and hours worked data from 2017.   Employers will file their regular 2016 report by September 30.  There would be no filings in 2017, giving employers 1.5 years to come into compliance under the new requirements.   Employers have until August 15, 2016 to submit written feedback to the...
